BUYING PROPERTY IN SLOVENIA

* Why buy property in Slovenia?

Both as vacation houses and residencies. This later is done especially by foreigners, having businesses in Slovenia. Some investment is done by foreing business companies.

* How to proceed for buying property? What legal arrangements are necessary?

When you select the property, a contract should be prepared. This can be done by anyone, though we strogly recommend, a lawyer or notary public is entrusted this task. . Afterwards, the notary public (compulsory) authenticates the sellers signature on the contract.
With this the contract becomes the basis for the buyer to be registred in the Land Register as the owner. This is important, as according to Slovene law, the act of registration of property rights in the Land Register is constitutive. The submission of the signed contract to the Court, that maintaines the Land Register, could be done by anyone, it is however recommended, that this be done by a lawyer or notary public.

* What taxes will be paid upon purchasing?
When the contract is signed it should be reported to the tax authority, which issues a payment order (a sales tax of 2% of the value of the property is levied). The tax authority confirms on the original of the contract, that the tax issue is settled.
When selling a newly constructed building the vendor (constructor) has to charge and pay 20% VAT (or 8,5% for residential property). VAT is levied also in cases when the vendor is a company, registred under the VAT law to levy VAT.

* What taxes will be paid later on (annual property taxation, rates etc. or upon future sale of purchased property)?

There is an annual tax on real estate property paid to the local authorities. A reform of this tax is scheduled for 2007 or 2008.
The income of rented property is taxed as a part of the total income of a person or company. A reform of these taxes is scheduled for 2007.
When selling property, a capital gain tax is levied on the difference between the acquisition price and selling price. The rate is 20%.
